U.S. Citizenship and Immigration Services (USCIS) announced that some parolees can now file Form I-765, Application for Employment Authorization, online.

According to USCIS information, most individuals paroled into the United States for urgent humanitarian or significant public benefit purposes under INA 212(d)(5) are eligible to seek employment authorization under category (c)(11).

So now, applicants for employment authorization under category (c)(11) may file Form I-765 online, with limited exceptions. Applicants seeking a waiver of the filing fee or those eligible for a fee exemption, such as Afghan nationals paroled through Operation Allies Welcome and filing an initial Form I-765, must continue to submit Form I-765 by mail.

To file Form I-765 online, eligible applicants must first visit my.uscis.gov to create a USCIS online account. There is no cost to create an account, which offers a variety of features, including the ability to communicate with USCIS about your application through a secure inbox.

USCIS Announces Parolees Can Now File Form I-765 Online

The option to file Form I-765 online is only available to certain categories of I-765 applicants – now including parolees. If an applicant submits Form I-765 online to request employment authorization but is not filing under an eligible employment authorization category, USCIS may deny the application and retain the fee.

Current, you can file Form I-765 online under the categories listed below:

  • (c) (3) (A) – Pre-completion OPT;
  • (c) (3) (B) – Post-completion OPT;
  • (c) (3) (C) – 24-month OPT extension for STEM students;
  • (12) – Temporary Protected Status (TPS);
  • (19) – Pending TPS applicants determined by USCIS as prima facie eligible for TPS and may receive an EAD as a temporary treatment benefit under 8 C.F.R. 244.10 (a);
  • (11) – Paroled for urgent humanitarian or public benefit purposes;

Keep in mind that those who are seeking a filing fee waiver or are eligible for a fee exemption, including Afghan paroled via Operation Allies Welcome filing their initial Form I-765, are required to continue filing by mail.

It should also be noted that those to attempt to submit a Form I-765, to request EAD under an ineligible category may have their application denied, and USCIS not refund the fee.
