Differences between Fiancé(e) Visa vs Spouse Visa

AS a U.S. citizen, you can bring your fiancé(e) to the United States to live here and get married with a fiancé(e) K-1 visa.

With this kind of visa, the foreign fiancé(e) will be able to travel to the U.S. and marry their sponsor within a 90-day deadline.

Each partner must provide a signed statement indicating an intent to marry within 90 days of the sponsored fiancé’s arrival in the United States.

So, the foreign fiancé(e) can apply for an adjustment of status to become a legal permanent resident.

You can bring your spouse to the U.S. by way of a Petition for Alien Relative (I-130), or nonimmigrant visa (K-3).

A “spouse” is characterized as a legally wedded husband or wife. This definition includes same-sex spouses of U.S. citizens and legal permanent residents.

With both kinds of visas, you must prove that you have a bona fide relationship.

The difference is with a fiancé(e) visa, you must get married in the United States within 90 days of arrival.

A K-3 spouse visa is designed to shorten separation between the foreign national and his or her U.S. citizen spouse.

What is the easiest way to bring my fiancé to USA?

Both processes are very similar, but the benefit of a fiancé(e) visa is that your fiancé(e) can join you in the country faster than with a spouse visa.

The problem is the cost is significantly higher for a K-1 fiancé(e) visa.

Keep in mind there are three major costs associated with a K-1 fiancé(e) visa:

  • Fee $535 to fill Form I-129F;
  • Fee $265.00 to be paid to the consulate;
  • Total $800.00

The following documents should be attached as evidence:

  • Proof of citizenship for the U.S. citizen fiancé;
  • Copy of the sponsored fiancé’s passport;
  • Proof of the legitimacy of the relationship;
  • Proof of having met in person at least one time within the two years prior to filing the form;
  • Sworn statements, written by and signed by each partner, with a brief description of the nature of the relationship and an intent to marry within 90 days of the sponsored fiancé’s arrival in the United States;
  • Copy of any Form I-94 arrival-departure record previously issued to the sponsored fiancé;
  • One passport-style photo of the U.S. citizen fiancé and one passport-style photo of the sponsored fiancé;

After the form and supporting documents are filed USCIS will usually send a receipt notice within 30 days.

USCIS may also send a Request for Evidence if they need more information.

Once Form I-129F is approved, USCIS will send an approval notice and your case will be sent for an interview at nearest U.S. Embassy/Consulate.

Things to bring for your K-1 Visa Interview:

  • A complete DS160 online Nonimmigrant Visa Application
  • A Valid Passport with a validity date at least six months beyond your intended period of stay in the U.S.
  • 2 most recent 2×2 photographs
  • Evidence of relationship with your U.S Citizen Fiancé (proof that the relationship with your U.S. fiancé is bona fide relationship)
  • Approval notice of your I-129F
  • Police Certificate clearances for all the places that you have resided for at least 6 months since the age of 16 years old.
  • Medical Exam
  • Birth Certificate, Divorce and Death Certificates if applicable
  • Financial Support from yourself and or U.S. Fiancé may be requested in other to show that you won’t become a public charge in the U.S.

The Consular officer may be entitled to ask for more information and documents if its needed.

At the end of your interview, you should receive a decision on your visa application, if approved your passport should be ready within 2 weeks after your interview.

After arriving in the United States, you and your fiancé will have 90 days to wed.
