Form I-600, Petition to Classify Orphan as an Immediate Relative. According to USCIS information, U.S. citizens use this form to request that USCIS classify an orphan as an immediate relative. The U.S. citizen’s adoptive parent or legal custodian files the petition to finalize the immigration process of a child who is not habitually resident in a Hague Convention country.

The objective of this Form I-600 is to classify a foreign national orphan who either is or will be, adopted by a US Citizen as an immediate relative of the US Citizen to allow the child to enter the United States. The petition is filed by the US Citizen who is adopting the child.

USCIS always requires that the Home Study be submitted with your Form I-600 application if it was not previously submitted with your Form I-600A application.

United States immigration law provides three different processes for immigrating based on adoption. The child may immigrate immediately after the adoption or may immigrate to the U.S. to be adopted under the:

• Orphan process if the Hague Adoption Convention does not apply;
• Hague process if they are habitually resident in a country that is a party to the Hague Adoption Convention;
• Another process, the family-based adoption petition process, may apply to certain U.S. citizens or lawful permanent residents if the child was adopted before age 16 (or age 18 if an exception applies), and has been in the legal custody of and lived with (jointly resided with) the adoptive parent for at least two years;

A fee of $775 may be required. A biometric services fee of $85 per individual is required for the petitioner, their spouse, and each adult member of the household unless previous fingerprint clearances are still valid, or the individuals are eligible for a one-time, no-fee re-fingerprinting. Fees depend on if you have filed Form I-600A and how many children you will be adopting.
